JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 15-12-2015 Petitioner is lodged in custody since 13.01.2015 in connection with Parsa P.S. case no. 8 of 2015 registered under Sections 8/20(b)(iii) 29 of the NDPS Act and diverse provisions of the Arms Act as well as the Indian Penal Code. The police raided the house of the petitioner and recovered 30 kg ganja kept in 30 packets, some live cartridges, stamps of other officers relating to the Education Department and mobile sets. Such seizure was made in presence of the petitioner. From the impugned order, it appears the petitioner took the plea that in conducting the seizure the provisions of the NDPS act was violated. The house was owned by the other family members earlier. The other accused persons have been released on bail. On going through the order dated 01.10.2015 (Annexure

Patna High Court Cr.Misc. No.51859 of 2015 (2) dt.15-12-2015 2/2 2/B) it appears that the other family members were implicated on the statement of the petitioner. The allegation is that the petitioner was found in possession of the recovered arms and contraband articles for which there was no explanation.

Considering the above, I am not inclined to release the petitioner on bail for the present. Prayer is, accordingly, rejected.
