JUSTICE NANI TAGIA ORAL ORDER 10-04-2025 This contempt petition has been filed alleging violation of the order dated 03.01.2019 passed in M.J.C. No. 1296 of 2015, wherein this Court had passed the following order:
"Considering the aforesaid, the Court is not inclined to proceed any further, however, liberty shall be available to the petitioner to challenge the legality of the order dated 31.07.2011 in appropriate proceeding.
Patna High Court MJC No.3320 of 2019(2) dt.10-04-2025 2/3 It goes without saying that the opposite parties shall ensure payment of the consequential benefit to the extent they have admitted in the order dated 31.07.2015 and ensure payment for the period 1.4.75 to 26.10.78 at the earliest preferably within a period of sixty days."
2. Opposite Party No.5 has filed the show cause, wherein, in paragraph Nos.4 and 5 it has been stated as under: "4. That in terms of the order dated 03.01.2019 passed by this Hon'ble Court in M.J.C. No.
1296 of 2015, this Opposite Party has already sent a letter to the Accountant General, Bihar, Patna vide Letter No. 157 dated 14.01.2021 alongwith the copy of two Service Book of the petitioner for calculating the service period of the petitioner from date 01.04.1975 to 26.10.1978 for pensionary benefit and requested to revise his pension after including the aforesaid period and to issue a fresh authority letter in favour of the petitioner.
5. That under the facts and circumstances stated hereinabove the order dated 03.01.2019 passed by this Hon'ble Court in aforesaid case has been complied with at the level of this deponent, so this show cause may kindly be accepted and the present contempt petition may kindly be disposed of and also exonerate this deponent

3. On perusal of paragraph Nos.4 and 5 of the show cause filed by the Opposite Party No.5, which is extracted hereinabove, I find that the order 03.01.2019 passed in M.J.C. No. 1296 of 2015 has been complied with by the Opposite Party No.5.
4. Accordingly, the contempt petition stands closed and disposed of.
