JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Gopalganj Nagar P.S. Case No. 565 of 2014 registered for the offence under Sections 341, 323, 324, 325, 307, 380, 376 and 458 of the Indian Penal Code.

Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation of any overt act against the petitioner. He further submitted that the other co-accused have already been granted bail by a co-ordinate Bench of this Court by order dated 20.05.2015 passed in Cr.Misc.No.16959 of 2015. Learned A.P.P. appearing on behalf of the State

Patna High Court Cr.Misc. No.2262 of 2017 (2) dt.13-02-2017 opposes the prayer of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Nagar P.S. Case No. 565 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
