JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gopalganj P.S. Case No. 293 of 2019 registered for the offences punishable under Sections 342, 307, 379, 302, 120 (B), 34 of the Indian Penal Code.

Allegation against this petitioner is that he along with other co-accused persons surrounded the deceased and thereafter co-accused Chandan Ram and Suraj Kumar stabbed brother of the informant repeatedly, due to which he succumbed to the injuries.

Submission of the learned counsel for the petitioner is that there is land dispute between the parties as such he has been falsely implicated in this case. There is no specific allegation of assault against this petitioner and similarly situated

Patna High Court CR. MISC. No.55144 of 2019(2) dt.02-09-2019 2/2 co-accused Raju Kumar has been granted bail vide order dated 26.8.2019 passed in Criminal Miscellaneous Case No. 53199 of 2019 by this Court. He has no criminal antecedent. Heard learned A.P.P. also.

In view of the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 293 of 2019 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
