Heard learned counsel for the petitioners, learned A.P.P. for the State and the learned counsel appearing on behalf of the informant.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 127(2), 115(2), 118(1), 109(1), 352, 303(2), 76 and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and are women

No.57662 of 2025(2) dt.03-09-2025 2/3 and the informant alleges that Sandesh caught him from behind and Sujeet assaulted by farsa causing injury on head, thereafter Anirudh and Bijli Patel assaulted him by lathi, further Sunil caught Anand from behind and Bijli assaulted him by an iron rod causing injury on head, thereafter Sujeet dashed his wife on the ground and Anirudh assaulted her by an iron rod causing injury on head, while Sandesh tore her cloth and Ramawati Devi took chain worth Rs. 75,000/- and Poonam assaulted his wife by lathi.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that entire family members including the female members have been implicated in order to coerce the male members into submission against who it is alleged that they assaulted. It is further submitted that no specific allegation of assault is alleged against the petitioners except Poonam that she also assaulted the wife of the informant by lathi. It is next submitted that allegation of snatching chain is ornamental.

Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bettiah Muffasil P.S. Case No. 229 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
