The petitioner seeks bail in Darpa P.S. Case No. 195 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.
As per the prosecution case, two unknown miscreants riding on motorcycle intercepted the informant and looted cash of Rs. 1,10,000/- from the dickey, Samsung tab, Bio-metric and fled away.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on his confession recorded in Darpa PS Case No. 13 of 2021 from which he has been remanded in this case. No looted article has
Patna High Court CR. MISC. No.70012 of 2021(2) dt.04-03-2022 2/2 been recovered from possession of this petitioner. No test identification parade has been held till date. Save and except his confession, there is no material against this petitioner. Petitioner is in custody since 21.06.2021.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Motihari, East Champaran in connection with Darpa P.S.
