JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Deo P.S. Case No. 45 of 2016, registered under Sections 147, 148, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code. The accusation is that, on 11.09.2016, in course of returning of Chandan Ram, son of the informant, to his house, nine persons named in the F.I.R. including the petitioners reached near him. At that time, Ram Nath Ram, caused injury through Garasa at the head of Om Prakash Ram. Baidhnath Ram caused

Bisunpat Ram caused injury through sword at the hand of Umesh Ram whereas Ramdhayan also caused injury through lathi to Chinta Kumari. The cause of occurrence is said to be land dispute. Learned counsel for the petitioners submits that while petitioners are named in the F.I.R. along with four others but no specific overt act has been attributed against the petitioners. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Deo P.S. Case No. 45 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
