JUSTICE RAJIV ROY ORAL ORDER 03-11-2025 Learned counsel for the petitioner prays for and is allowed to implead the Commissioner, Saran, Chhapra as respondent No. 8 during the course of the day.

2. Heard the parties.

3. The petitioner, in the present writ petition, has prayed for the following reliefs :- "I. To direct the respondent authorities to make sufficient adequate and satisfactory payment as compensation treating the land as residential cum commercial land alongwith compound interest on delay

Patna High Court CWJC No.22380 of 2018(2) dt.03-11-2025 2/3 payment to the petitioner with immediate step as per the new rule of land acquisition in the light of judgment of Hon'ble High Court as well as Hon'ble Apex Court.

In view of the facts the precious land of petitioner has been acquired construction of for link road connecting to Digha.

Pahleza Setu with Sonepur Chapra Ν.Η.19 Road and following plots of petitioner has been acquired at village Chausiya, Sultanpur :- Plot No.

76, 22, 23, 24, 74, 138, 142.

Rakba-0.00698 + 0.04210 +0.01100 + 0.14237 + 0.03093 + 0.02000 Acre respectively vide Khata No. 47 Surprisely without making payment as compensation is in progress due to malafide intention and oblique reason.

II. To provide compensation for temporary house cum cattle shed and trees also which has been acquired but it has not been reckoned for compensation.

III. To provide compound interest on delay payment.

IV. To impose heavy cost upon erring authorities and also a departmental

V. Any other relief / reliefs for which the petitioner is entitled for."

4. After some argument, learned counsel for the petitioner submits that he shall be approaching the Commissioner, Saran, Chapra (Respondent No. 8) for the redressal of his grievance in the next eight weeks.

5. If such petition is filed, the concerned respondent shall be taking the same to its logical conclusion after hearing all the necessary parties.

6. With the above observation, present writ petition stands disposed of.
