The petitioner seeks bail in a case instituted for the offence under Sections-144 and 379 of the Indian Penal Code and 27 of the Arms Act.

It is alleged in the written report that Pradeep Bhuiyan and Sudama Bhuiyan made firing from the gun.

It has been submitted on behalf of petitioners that petitioners are named in the written report as members of unlawful assembly. From perusal of the written report itself, it appears that the occurrence took place on account of land dispute. The petitioner is said to be in custody since 08-102016. Case No. 01 of 2010 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya subject to condition that both the bailors will be close relatives of the petitioner.
