JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-02-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bettiah Town (Kalibag O.P.) P.S. Case No. 517 of 2022, registered for the offences punishable under Sections 420, 376, 504/34 of the Indian Penal Code and Section 8 of the POCSO Act.

The learned counsel for the petitioner has submitted that there is no allegation against the petitioner of having physical relation with the victim. It is only against co-accused Md. Rehan, who is brother of the petitioner. He has falsely been implicated merely on the allegation that she complained against

Patna High Court CR. MISC. No.57504 of 2022(2) dt.09-02-2023 2/2 the petitioner that he abused her. He has submitted further that the informant is married lady and there was extra-marital relationship between the informant and Md. Rehan, brother of the petitioner.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO-cum-ADJ-VI Bettiah, West Champaran in connection with Bettiah Town (Kalibag O.P.) P.S. Case No. 517 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.
