JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that accused persons including the petitioner got consumer connection connected with transformer without any proper connection which was protested by the informant's side when co-accused Munna Singh and Dhiraj Singh fired with riffle causing injury to the informant and Rajendra Raut. The other accused persons assaulted with lathi to the informant's side. It is submitted by learned counsel for the petitioner that petitioner was not sent up for trial but differing with the final form, cognizance has been taken on 24.06.2004. Considering the fact that case was instituted

Patna High Court Cr.Misc. No.54718 of 2015 (2) dt.03-12-2015 2/2 in the year 2001 and the petitioner has been named in the First Information Report, this Court is not inclined to grant anticipatory bail to the petitioner. Let learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Civil Lines P.S. Case No. 234 of 2001, pending in the Court of learned Adhoc Additional Sessions Judge-II, Gaya. With the observations above, the application stands disposed off.
