The petitioner is accused in connection with Jagdishpur P.S. Case No. 142 of 2016 registered under Section 25(1-b)a, 26 and 35 of the Arms Act.
The accusation is of recovery of two country made pistol, one empty magazine and eight empty cartridges from the house of the petitioner.
Learned counsel for the petitioner submits that while the allegation has been made about recovery of two country made pistol, one empty magazine and eight empty cartridges from the house of the petitioner but the seizure list does not bears the signature of petitioner and his family members. Moreover, the
Patna High Court Cr.Misc. No.234 of 2017 (2) dt.12-01-2017 alleged arms have been recovered from the joint house of the petitioner and other agnates. It is further submitted that petitioner has no criminal antecedent and is in custody since 01.08.2010. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Jagdisdhpur P.S.
