JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-12-2015 Petitioners, who are father-in-law, brother-in-law, sister-in-law and mother-in-law of the deceased respectively, apprehend their arrest in a case under sections 304B, 201 and 34 of the Indian Penal Code.

Petitioners submit that the allegations are general, compromise has also been arrived at between the parties and husband of the deceased is already in custody. In the facts of the case, in case of surrender, let petitioners no.2, 3 and 4, named above, be released on bail on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Sheohar in Tariyani Police station Case No. 50/2015.

In my view, if the petitioner no. 1 surrenders and prays for

Patna High Court Cr.Misc. No.50842 of 2015 (3) dt.22-12-2015 2/2 regular bail, the same would be disposed of preferably on the same day on its own merit without prejudice, also taking into consideration that the allegations are general and husband of the deceased is already in custody and parties have compromised the matter.

The bail petition is thus disposed of.
