The petitioner is accused in connection with Pirbahore P.S. Case No. 98 of 2016 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but his name has been surfaced in course of investigation in the confessional statement of co-accused, Akash Kumar @ Chhotu and Jitendra Kumar except that there is nothing against the petitioner showing his involvement in the present case. Further submission is that, in fact, petitioner was apprehended by the police in connection with
Patna High Court Cr.Misc. No.2438 of 2017 (2) dt.04-02-2017 Kadamkuan P.S. 174 of 2016 thereafter he was remanded on 10.05.2016 in the present case and since then he is in custody. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No. 98 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
