====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 06-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Town P.S. Case No. 725 of 2022 dated 02.12.2022 registered for the offences punishable under Sections 341, 147, 148, 149, 353, 307, 224, 225 and 323 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and other co-accused persons created hindrance in discharging the official duties of the police personnel. When they intercepted, the petitioner alongwith his associates assaulted the police personnel, namely, Mahesh Kumar and Shiv Shakti Kumar.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.63041 of 2023(2) dt.06-10-2023 2/3 that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is a member of unlawful assembly and the allegation against the petitioner is of teeth bite on the finger of one police personnel, namely, Mahesh Kumar, which is simple in nature. However, the said allegation is untrue. The petitioner has one criminal antecedent. Other similarly situated co-accused persons have been granted bail by different Coordinate Benches of this Court vide Cr. Misc. No. 14532 of 2023 under order dated 27.04.2023, Cr. Misc. No. 33732 of 2023 under order dated 24.06.2023 and Cr. Misc. No. 34159 of 2023 under order dated 24.06.2023, annexed as Annexures- '3', '3A' and '3B' to the bail application. The petitioner is rotting in jail custody in this case since 01.07.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Begusarai, in connection with Town P.S. Case No. 725 of 2022.
