====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 420, 406, 307, 504, 498A of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition At.

Petitioner is husband of opposite party no. 2. There is allegation of demand of dowry and torture for the same. The matrimonial dispute between the spouse had led to filing of several cases including a case under the Domestic Violence Act

Patna High Court CR. MISC. No.55329 of 2019(3) dt.03-12-2019 2/2 by opposite party no. 2. The matter was sent for reconciliation which has failed.

Learned counsel for the petitioner submits that opposite party no. 2 herself is a quarrelsome lady and off-and-on leaves the matrimonial house without informing anyone and her behaviour with the family members has created havoc in the family.

Considering the entire facts of this case, especially nature of allegation, in my view, this is not a fit case for grant of anticipatory bail in connection with Trial No. 2854 of 2018 arising out of Complaint Case No. 1446 of 2018 pending in the court of learned Sub-Divisional Judicial Magistrate, East Muzaffarpur.
