JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Petitioners are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 147, 149, 323, 341, 379 of the Indian Penal Code and Section (1)(x) of the SC & ST (Prevention of Atrocities) Act and Section 27 of the Arms Act.
The accusation is of assaulting the informant and abusing by calling caste name and when the witnesses tried to rescue the complainant then they were also assaulted. It is further alleged that petitioner No. 1 Nawal Kishore Singh put pistol on the temporal region and ordered other persons to snatch the money when co-accused Ashok Singh snatched Rs. 25,000/- of the informant.
It is submitted by learned counsel for the petitioners that for a petty dispute the accusation has been
Patna High Court Cr.Misc. No.53277 of 2015 (2) dt.23-11-2015 2/2 levelled. Moreover for the occurrence of 07.04.2013 the complaint was filed on 11.04.2013 when none have received any injury.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the delayed lodging of the complaint, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur in connection with Complaint Case No. 380(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
