JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-10-2018 The learned counsel for the petitioner submits that the work in question was completed by the petitioner herein, however, the admitted dues has not been paid whereas on the contrary one another person namely Vinod Kumar Singh has claimed payment for the same work and had approached this Court by filing a writ petition bearing C.W.J.C. No. 1766 of 2017 and this Court vide an

Patna High Court CWJC No.6724 of 2018 (2) dt.29-10-2018 2/2 order dated 07.03.2018 had remanded the matter to the Principal Secretary, Building Construction Department, Government of Bihar, Patna for adjudication of the representation to be filed by the said Vinod Kumar Singh.

The learned counsel for the petitioner submits that the petitioner be also relegated to the respondent no.2 with a direction to adjudicate his claim.

In view of the limited submissions of the learned counsel appearing for the petitioner, I deem it fit and proper to grant liberty to the petitioner to file a representation before the respondent no.2 within a period of four weeks from today and in case such a representation is filed, the same is directed to be disposed off by the respondent no.2 within a period of eight weeks thereafter, after considering the claim of the petitioner as also after making an enquiry as to the admissibility of the claim as far as the aforesaid another person is concerned.

The present writ petition is disposed off on the aforesaid terms.
