A supplementary counter affidavit has been filed on behalf of the respondent nos. 2 and 4 namely the Superintendent of Police, East Champaran, Motihari and Officer In-charge, Rajepur Police Station, East Champaran at Motihari. A categorical statement has been made in paragraph 5, 6 and 7 that the boy was recovered and produced before the Magistrate and his statement under Section 164 Cr.P.C. has

Patna High Court Cr. WJC No.83 of 2017 dt.26-04-2017 been recorded which has been brought on record as AnnexureF. Thereafter the boy was handed over to the father who has acknowledged the same in writing which has been brought on record as Annexure-G.

In above view of the matter since the boy has already been recovered and handed over to the father, this application stands disposed of.
