JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 413 and 414 of the Indian Penal Code. Petitioner is in custody since 22.09.2016 with allegation that a stolen motorcycle was recovered from his possession and co-accused Md.Asgar Alam. Md. Asgar Alam has already been allowed bail by a coordinate Bench of this Court in Cr.Misc.No.55744 of 2016.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea/Successor

Patna High Court Cr.Misc. No.2629 of 2017 (3) dt.18-04-2017 Court, in connection with K. Hat (Sahayak) P.S. Case No.433 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
