JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-09-2022 Though the present writ petition was filed for implementing the order dated 20.03.2018 passed by the Circle Officer, Balrampur, District- Katihar in Encroachment Case No. 01 of 2017-18, and for removal of encroachment in question, however, the learned counsel for the respondent-State has submitted that a counter affidavit has been filed in the present case, which though is not on record, wherein it has been stated that the entire encroachment in question has been removed, in response whereof, the learned counsel for the petitioner has submitted that though it is a fact that almost entire encroachment has been removed, however, some portion is yet to be removed,

Patna High Court CWJC No.21549 of 2018(2) dt.12-09-2022 2/2 hence, for the said purposes, the petitioner be granted liberty to approach the District Magistrate, Katihar for needful action. Liberty so sought, is granted.

The writ petition stands disposed off.
