Heard learned counsel for the petitioners and the learned APP for the State.

The petitioners apprehend their arrest in connection with Dhansoi P.S. Case No. 97 of 2023 dated 08.07.2023, registered for the offences punishable under Sections 147, 149, 341, 323, 307 and 504 of Indian Penal Code.

The main submissions advanced by learned counsel for petitioners are that altogether 14 persons including the petitioners have been named in the FIR, a land dispute, which is admittedly running in between both the parties is said to be the genesis of the occurrence, against the petitioners there is no serious allegation and they allegedly caught hold of the

No.59943 of 2023(2) dt.11-10-2023 2/2 informant's brother namely, Golu Kumar, when he was being hit by the co-accused Saheb Ram, and as per order impugned the informant's brother Golu Kumar sustained simple injuries and both the petitioners have fair and clean antecedent. 4.

Learned APP for the State opposes the bail prayer of the petitioners.

Considering the above submissions and mainly the nature of allegation appearing against the petitioners as well as the fact that they have fair and clean antecedent, in my opinion, the petitioners deserve to the privilege of anticipatory bail. Accordingly, let the petitioners named-above in the event of their arrest/surrender before the learned Court below within a period of six weeks from today, be released anticipatory bail in connection with Dhansoi P.S. Case No. 97 of 2023 on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of concerned Court, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
