The petitioner seeks bail in Sonbarsa P.S. Case No. 251 of 2021, registered for the offence punishable punishable under Section 414 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

286 litres of Nepali Saufi liquor has been recovered from a Maruti car of which this petitioner is one of the occupants who fled away after seeing the police party. It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and has got no concern with the seized liquor. Petitioner is in custody since 04.10.2021 having no criminal antecedent, as stated in para 3 of the petition.

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge Excise Act, Sitamarhi in connection with Sonbarsa P.S.
