JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ariyari P.S. Case No. 104 of 2017, registered under Sections 406, 409, 420, 467, 468 and 471/34 of the Indian Penal Code. The accusation is that, on inquiry, irregularities were found in nine Schemes under Manrega, while some persons were dead, but payment was made against them and some were also paid, who were not engaged in doing the work of Manrega Scheme and the Manrega Scheme also found incomplete. Learned counsel for the petitioner submits that, in fact, petitioner was posted as Panchayat Technical Assistant at

Patna High Court Cr.Misc. No.47323 of 2017 (2) dt.04-10-2017 Panchayat Hussainabad in between 30.11.2010 to 30.06.2011 and during that period no measurement was done by the petitioner regarding the Manrega Scheme, which would appear from the inquiry report.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sheikhpura, in connection with Ariyari P.S. Case No. 104 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
