JUSTICE ARUN KUMAR ORAL ORDER 13-11-2017 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Complaint Case No.C-I/118/17, registered under Sections 406, 420, 379, 384, 341 and 504 of the Indian Penal Code. Allegation is that the accused persons were renters in the house of the complainant, on demand of rent, they assaulted the complainant and committed the occurrence. Learned counsel for the petitioners submits that in fact there is dispute relating to ownership of the house. The petitioners

Patna High Court Cr.Misc. No.52915 of 2017 (2) dt.13-11-2017 2 /2 had made payment of the consideration money to the father of the complainant but the sale deed was not executed. In any way the dispute is between the tenants and the landlord relating to rent. Having considered the said facts and circumstances, let petitioners, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Sitamarhi in connection with Complaint Case No.C-I/118/17, subject to the conditions laid down under Section 438(2) Cr.P.C.
