JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 366A, 504/34 of the Indian Penal Code.

The accusation is of kidnapping the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the victim is major and has performed marriage with the petitioner of her own. The petitioner undertakes to produce the victim girl before the learned court below on 1st December 2015 when the learned court below will record her statement. Considering the present stand of the petitioner, let him be released on provisional anticipatory bail for one month, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of

Patna High Court Cr.Misc. No.51487 of 2015 (2) dt.10-11-2015 2/2 `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Muffasil P.S. Case No.196 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below, if in the statement of the victim girl recorded by the court below, she admits her marriage with the petitioner of her own but if she denies the marriage then the petitioner will surrender and pray for regular bail.
