The petitioner apprehends her arrest in connection with Harsidhi P.S. Case no. 51 of 2017, registered under Sections 341, 323, 324, 325 and 307/34 of the Indian Penal Code. The accusation is that while informant Harinandan Sahai was returning to his house from the Police Station after giving application regarding committing Marpit by Fulena Sahani and others then in the way this petitioner caught hold him from the back and Nilam Devi caused injury at his head through Farsa in which he sustained injury.
Learned counsel for the petitioner submits that, in fact, occurrence of Marpit took place due to land dispute in which Vikas Sahni, son of the petitioner, sustained injury regarding which Harsidhi
Patna High Court Cr.Misc. No.47283 of 2017 (2) dt.04-10-2017 2/2 P.S. Case No. 41 of 2017, under Sections 147, 149, 323, 324, 367, 436, 379 and 504 of the Indian Penal Code is instituted against informant and his family members of the present case and only to give undue pressure, the informant lodged the present case after six days of the occurrence on 12.02.2017. Moreover, the allegation of causing injury to the informant is against co-accused Nilam Devi. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 51 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
