JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Gaurichak P.S. Case No. 159/2019, registered for offences punishable under Sections 376, 328, 506 of the Indian Penal Code and later on added Sections 67, 67(a) and 67(b) of the I.T. Act and Section 4 of the POCSO Act.

Allegation against the petitioner is of committing rape on the minor daughter of the informant.

It has been submitted on behalf of the petitioner that during trial victim girl as well as her father and mother has been examined and their deposition has been brought on record by learned Counsel for the petitioner by way of supplementary affidavit and in their deposition, they have not supported the case of prosecution. Further submission is that petitioner has been in custody since 05.04.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -I, Patna, in connection with Gaurichak P.S. Case No. 159/2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
