The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 25(1-B)a, 26, 35(37B) of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that no incriminating article has been recovered from the possession of the petitioner. He submits that there is no specific overt act against the petitioner. He submits that the apprehended person disclosed the name of the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application. Learned APP for the State opposes the prayer for bail and submits that witnesses have supported the alleged incident committed by the petitioner with the assistance of other

Patna High Court CR. MISC. No.58005 of 2022(2) dt.20-12-2022 2/2 accused persons.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Alamnagar P.S. Case No. 155 of 2022.
