The petitioner apprehends his arrest in connection with Town P.S. Case no. 116 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that in course of raid of house of petitioner, 12 bottles, each containing 750 ML Indian made foreign liquor recovered from the house of petitioner, where Murari Kumar and Chintu Kumar were apprehended. Learned counsel for the petitioner submits that, in fact, Murari Kumar, son of petitioner, and Chintu Kumar kept the alleged liquor in his house without the information of the petitioner. At that time, Murari Kumar, son of petitioner was apprehended and petitioner being the father of Murari Kumar

Patna High Court CR. MISC. No. 59921 of 2019(2) dt.23-09-2019 2/2 has also been implicated in this case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with Town P.S. Case No. 116 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
