The petitioner apprehends his arrest in connection with Inarwa P.S. Case No.56 of 2020, giving rise to Trial No.4143 of 2021, registered for the offences punishable under Sections 147, 148, 341, 323, 324, 307, 337, 338, 504 and 506 of the Indian Penal Code.

The petitioner is said to have assaulted the informant with iron rod over her head due to which she sustained head injury. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted

Patna High Court CR. MISC. No.58010 of 2022(6) dt.16-02-2023 2/2 that injury sustained by the informant is simple in nature. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner.

Considering the fact that the injury sustained by the informant is simple in nature, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Inarwa P.S. Case No.56 of 2020, giving rise to Trial No.4143 of 2021, subject to the conditions laid down under Section 438 (2) of the Code of Criminal Procedure. Personal appearance of the Superintendent of Police, West Champaran (Bettiah), the S.D.P.O., Narkatiaganj, West Champaran, the Investigating Officer, Inarwa Police Station, West Champaran (Bettiah) and Inspector, Mainatand Circle, West Champaran is dispensed with.
