2. The petitioner seeks regular bail in connection with Bhagwanpur Hat P.S. Case No. 249 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.
3. As per the prosecution case, on getting secret information police party reached at the marked place and recovered 347.250 litre country made liquor. It is alleged that four accused persons were arrested on the spot while trying to flee away from there.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Petitioner has no concern with the seized

Nothing has been recovered from the conscious possession of the petitioner rather recovery has been made from the bush near the Mirjumala bridge. Petitioner was passing through the way and due to suspicion he was arrested. Petitioner has four criminal antecedents of similar nature. He is in judicial custody since 10.06.2025. It is submitted that similarly situated co-accused, namely, Dinesh Kumar Upadhyay @ Dinesh Kumar has already been granted bail by this Court vide order dated 10.09.2025 passed in Cr. Misc. No. 58793 of 2025.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. I, Siwan in connection with Bhagwanpur Hat P.S. Case No. 249 of 2025.
