The petitioner apprehends his arrest in connection with Udakishunganj P.S. Case No.128 of 2016 registered under Sections 420, 468 and 477/34 of the Indian Penal Code. The accusation of the complainant/informant is that his father, Late Triveni Prasad Singh, had five brothers and one of the brothers of his father, namely, Saryug Prasad Singh, was the father of Ramanand Singh and Parmanand Singh. The property was joint. Parmanand Singh was not ready to partition the land and he sold the land of his share without information and he again sold the land through two different sale deeds on 29.03.2016, one in the

Patna High Court Cr.Misc. No.694 of 2017 (2) dt.18-01-2017 2/2 name of Nand Kishor Yadav (petitioner) and another to his younger daughter-in-law and his grand son on which Mukesh Kumar Singh put his signature as identifier.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has purchased the land from Parmanand Singh, the Pattidar of the complainant/informant but, with an ulterior motive, the petitioner has falsely been made accused in the complaint case with false allegation, which is the basis of the F.I.R.. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Udakishunganj at Madhepura, in connection with Udakishunganj P.S. Case No.128 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
