JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-02-2023 Heard the learned counsel for the petitioner and the learned APP for the State. The petitioner seeks regular bail in connection with Motihari Muffasil P.S. Case No.377 of 2022, registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code and Section 8 of the POCSO Act.
The allegation is regarding the accused persons including the petitioner herein, having kidnapped the victim girl with ulterior motive. The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case, he
Patna High Court CR. MISC. No.57532 of 2022(3) dt.07-02-2023 2/3 is having a clean antecedent and he is languishing in custody since 23.05.2022. The learned counsel for the petitioner has further submitted by referring to the statement made by the victim girl under Section 164 Cr.P.C., before the learned Magistrate, that the victim girl has though stated that four people had kidnapped her, but she had only identified one of them, namely, Navneet, however, she has categorically stated that no untoward incident had taken place with her.
Per contra, the learned APP for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also considering the statement made by the victim girl under Section 164 Cr.P.C., before the learned Magistrate, as aforesaid, I deem it fit and proper to direct for release of the petitioner on regular bail.
Accordingly, the above named petitioner
Patna High Court CR. MISC. No.57532 of 2022(3) dt.07-02-2023 3/3 is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Session Judgecum-Special Judge POCSO, Motihari, East Champaran in connection with Motihari Muffasil P.S. Case No.377 of 2022.
