The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Recovery of liquor is not alleged from the possession of the petitioner; rather name of the petitioner surfaced in the confessional statement of co-accused. The petitioner has stated on oath that he has got no such type of criminal antecedent.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court CR. MISC. No.56179 of 2019(2) dt.06-09-2019 2/2 amount each to the satisfaction of the learned Court-below where the case is pending in connection with Buxar (Town) P.S. Case No.496 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
