In this case, the petitioner is seeking bail in connection with Bagaha (Bhairoganj) P.S. Case No. 347 of 2015 registered for offences under sections 366(A), 341, 323, 504, 506/34 of the Indian Penal Code.

Allegation of kidnapping for the purposes of marriage has been alleged.

The statement of the victim-girl shows that 19 days before, the petitioner went to the house of the victim and told her to go along with him to the house of uncle and all the 19 days she remained with the petitioner and made an allegation that forcibly the petitioner entered into marriage with the victim. The counsel for the petitioner submits that for 19

Patna High Court Cr.Misc. No.51596 of 2015 (3) dt.19-02-2016 2/2 days, she was always moving here and there with the petitioner, but she never raised alarm which appears that she had gone on her consent with the petitioner who has wrongly been trapped in the present case.

Looking to the nature of allegation, facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha (Bhairoganj) P.S. Case No. 347 of 2015.
