Petitioner seeks regular bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, 8-9 miscreants, on the point of pistol, looted cash of Rs. 17,56,299/- from the informant an fled away.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case. His name has transpired during the course of investigation on the basis of confessional statement of co-accused. It is further submitted that no looted article has been recovered from him.

Patna High Court CR. MISC. No.69488 of 2021(2) dt.04-03-2022 2/2 Test Identification Parade has not been carried out till date and the only allegation is that as per the Call detail report, petitioner was in conversation with other accused persons at the relevant time. Petitioner is in custody since 27.6.2021. Similarly situated accused Krishna Kumar Singh has already been granted bail by this court vide order dated 13.12.2021 passed in Cr. Misc. No. 38785/2021.

In that view of the matter, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Chapra, Saran, in connection with Ekma Police Station Case No. 177 of 2021/UTNo.351/21.
