JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-05-2019 Mr. Ram Narayan Mahto, learned counsel for the petitioner has filed his reply, responding to the Court's order dated 25.02.2019. The reply is accepted.

Though, the matter has been listed with certain office notes, pointing out defects in the writ application, however, considering the nature of defects, the same have been ignored and I have proceeded to hear the matter on merits. Heard learned counsel for the petitioner and AC to SC-25 for the State.

This writ application has been filed, seeking the

Patna High Court CWJC No.3137 of 2019(6) dt.06-05-2019 2/3 following relief:- "1. That this is an application for issuance of an appropriate writ(s), order(s), direction(s) to the Respondents for demarcating the land Basgit Purcha holders which has been issued on 13.04.2010 by the Circle Officer, Khutouna being Khata No.36, Plot No.337 total area 1 katha 5 dhur which is situated in Bagmria BlockKhutauna, District-Mahubani on the ground of petitioner has applied for Basgit Parcha being Case No. 55/2001-2002 and after due verification parcha has been issued to the name of petitioner and who has paid the revenue to the govt. and rent receipt has got and after demarcation of land further give the direction to the Respondents to give the possession to the petitioner who has filed sevral representation before authorities with regard to his grievances but authorities are sitting over the matter and matter is pending."

The petitioner has statutory remedy under the Bihar Land Disputes Resolution Act, 2009 (for short 'the Act'), which he has apparently not availed.

This writ application is disposed of with an observation that the petitioner shall be at liberty to approach the competent authority under the aforesaid Act, by making appropriate application, in the light of the provisions under the Act and rules framed thereunder. If such an application is made
