JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 09-02-2023 Heard learned counsel for the petitioner as well as learned counsel for the opposite party no. 2. The petitioner apprehends his arrest in connection with Complaint Case No. 1136C of 2021, registered for the offences punishable under Sections 323, 498 (A), 494, 504, 120(B) of the Indian Penal Code but cognizance has been taken under sections 498 (A), 504, 34 of the Indian Penal Code. It is a case of matrimonial dispute. The complainant has made allegation against the petitioner that he demanded Rs. 50,000/- as dowry and due to non-fulfillment of the demand she was ousted from her matrimonial house.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.57526 of 2022(2) dt.09-02-2023 2/2 that the complaint petition shows itself that from the year 2000 to 2013 the complainant was residing in her matrimonial house. He has also submitted that the matter has become irretrievable. On the other hand, learned counsel for the O.P. No. 2 has opposed the prayer for bail and submitted that the petitioner tortured the victim for non-fulfillment of demand of dowry. Considering the above-mentioned facts and circumstances, the petitioner is directed to make a payment of Rs.4,000/- per month to the complainant.

The payment of amount shall be subject to final outcome of maintenance case filed by the complainant, if any. Accordingly, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Complaint Case No. 1136C of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
