Learned counsel for the petitioner submits that the present writ application has been filed seeking a direction upon the respondent authorities to construct the drain from the house of the petitioner to Sasta Khadi Bhandar in Ward No. 7 along with chamber.

Learned counsel submits that in absence of drain in the area concerned, the life of the citizens during rains become

Patna High Court CWJC No.22546 of 2018(2) dt.04-05-2023 2/2 miserable, it is next submitted that it is the duty of the Nigam to ensure that the citizens at least live with dignity. Learned counsel appearing for the Nigam Mr. Bajrangi Lal submits that he had taken instructions from the Municipal Commissioner with regard to the issue raised in the present writ application, it is next submitted that he has instructions to make submissions that a tender would be issued expeditiously for constructing the drain in question along with other works and if possible, the drain would be constructed within a period of six months from today.

Considering the submissions made by the learned counsel for the Nigam, the Court does not feel inclined to proceed with the writ application, the writ application is disposed of with a direction to the petitioner to file afresh representation before the Municipal Commissioner along with the copy of this order for taking action in pursuance of the submissions made by the learned counsel for the Nigam. The writ application is thus disposed of.
