The petitioners apprehend their arrest in connection with Narpatganj P.S. Case No.351 of 2017/G.R. No.2565 of 2017 registered under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
The accusation is that on 27.07.2017, when the son of the informant was making conversation with a person of the T.V.S. Company, at that time, Md. Afaque started to cause assault to the son of the informant through lathi and danda and the son of the informant fled away from there and reached at his house and when
Patna High Court Cr.Misc. No.51152 of 2017 (2) dt.31-10-2017 2/3 he was giving information to the informant and his family regarding the same, Md. Afaque alongwith the petitioners came there and all started to cause assault to the son of the informant. When the husband of the informant tried to pacify the matter, at that time, Md. Rauf (petitioner no.2) put the husband of the informant on the ground and Md. Afaque caused injury on his head and other parts of the body through peg and snatched Samsung mobile and cash Rs.5000/- from the pocket of the son of the informant.
Learned counsel appearing on behalf of the petitioners submits that the specific allegation is against Md. Afaque to cause injury at the head and other parts of the body of the husband of the informant through peg. The petitioners, who are neighbours of the informant, have falsely been implicated in this case. While there is general allegation against the petitioners and Md. Afaque to cause injury to the son of the informant but no injury was sustained by him. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the
