2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 328, 323, 376, 379, 385 and 506 of the Indian Penal Code and Section 67(a) of the I.T. Act.

3. The case of the prosecution is that the informant is the sister-in-law of the brother of the petitioner. Since they were in relation, they started talking to each other. It is further submitted that the informant and the petitioner developed relationship and the request of the petitioner, the informant went in a room of a hotel. It is further alleged that there she was

It is further alleged that the petitioner has made video of the act and was threatening the informant that he will make the video viral. It has further been submitted that the video was made viral and the petitioner was demanded five lacs rupees from her.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that vide order dated 09.09.2024 the petitioner was granted provisional bail as during hearing it has come before the Court that parties are ready to solemnize marriage. From perusal of the FIR, it is clear that there is delay in filing of the FIR and from perusal of the record it also transpires that the room in which it is alleged that the physical relation was established forcefully with the informant was booked by the informant herself. It seems to be a case of relationship outside marriage. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.

5. Today, the learned counsel for the petitioner has submitted that the informant is doing B.Sc in nursing and that

6. Learned counsel for the informant is also present and he has stated that this is real state of affair.

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, the provisional bail granted to the petitioner vide order dated 09.09.2024 is hereby confirmed.

8. This application stands allowed.
