2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8(c), 9(A), 21(c), 25, 25A and 29 of the NDPS Act.

3. The case of the prosecution is that on the basis of specific information, two kilograms of heroin from Tata Punch car bearing registration no. BR06DH-1768 and two persons, namely, Ratnesh Kumar Mishra and Dharamveer Kumar Pandey were apprehended.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.62068 of 2025(4) dt.05-02-2026 2/3 petitioner is innocent and has committed no offence. The name of this petitioner has come on the basis of confessional statement of co-accused person. Learned counsel for the petitioner has further submitted that there is no any recovery of contraband from the possession of this petitioner. Moreover, the petitioner is languishing in judicial custody since 13.12.2024. It has also been submitted that other co-accused person has already been granted bail by this Court vide order dated 15.12.2025 passed in Cr. Misc. No. 50294 of 2025.

5. Learned APP appearing for Union of India has vehemently opposed the prayer of regular bail and has submitted that on the disclosure of this petitioner, from the house of Sarvesh, certain chemicals were recovered which are used in manufacturing contraband.

6. Countering this, learned counsel for the petitioner has submitted that, if at all, the recovery was made from the house of Sarvesh Kumar not from the house of this petitioner.

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with NCB Case No. PZU/V/12 of 2024 on furnishing bail bond of

Patna High Court CR. MISC. No.62068 of 2025(4) dt.05-02-2026 3/3 Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari.
