The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the police after investigation submitted charge-sheet under Sections 392 and 397 of the Indian Penal Code. It is further submitted that the petitioner is in custody since 24.02.2021, charge-sheet has been submitted in the case and has antecedent of three cases. Learned counsel for the petitioner submits that the informant alleges that he was intercepted by two unknown motorcycle borne criminals who looted him of Rs. 57,500/-. Learned counsel for the petitioner submits that F.I.R.

Patna High Court CR. MISC. No.69344 of 2021(2) dt.26-04-2022 2/2 was against unknown and despite the petitioner being in custody was not put on T.I.P. nor recovery of any incriminating article was made from his possession and further his name came in the confessional statement of co-accused merely because he has got criminal antecedents.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and was not put on TIP nor any incriminating article was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Barauni Garhara P.S. Case No. 49 of 2021 with a condition that one of the bailors of the petitioner shall be his father, Shambhu Singh. (Satyavrat Verma, J) Rishi/- U T
