Learned counsel for the respondent-Corporation files a counter affidavit to submit that the writ petition has become infructuous as the property in question has since been auctioned and a registered sale deed has been executed in favour of the auction purchaser. It is further submitted the writ petition is not maintainable also because the auction purchaser being a necessary party has not been impleaded as party respondent.
