The petitioner seeks bail in connection with Mairwa P.S. Case No. 165 of 2021 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 06.09.2021, charge-sheet has been submitted in the case and has antecedent of one case and the informant alleges that he parked his motorcycle and went to a shop and when he returned the motorcycle was missing. The learned counsel submits that FIR was against unknown, the motorcycle was recovered from the possession of one Govind Ram and the petitioner was also arrested as he was also present along with Govind Ram and thereafter Guthni P.S.
Patna High Court CR. MISC. No.70139 of 2021(2) dt.27-04-2022 2/2 Case No. 141 of 2021 was instituted in which the petitioner was made to confess his participation in the present crime. The learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that petitioner is in custody since 06.09.2021, charge sheet has been submitted in the case and nothing was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mairwa P.S. Case No. 165 of 2021.
