In this case, the petitioner is seeking regular bail in connection with Kahalgaon (Shiv Narayanpur) P.S. Case No.159 of 2015, registered for the offences under Sections 341, 323, 379, 307, 504/34 of the Indian Penal Code.

As per the allegation the victim and the aggressor party are the neighbours. Dispute arose on account of certain piece of land and altercation took place. Allegation has been made against the petitioner that he caused injury to the victim by Khunti. Learned counsel for the petitioner submits that the nature of allegation that has been shown in the medical report does not testify the version of the victim of causing injury by Khunti and so much so that Annexure-3 itself shows that the day he was admitted and on the same day he was discharged from the

Patna High Court Cr.Misc. No.51355 of 2015 (2) dt.03-02-2016 2/2 hospital.

Looking to the entire facts and circumstances of the case, let the petitioner-S.K. Safique be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Bhagalpur, in connection with Kahalgaon (Shiv Narayanpur) P.S. Case No.159 of 2015 (G.R. No.1447 of 2015).
