The petitioners apprehend their arrest in connection with Madhepura (Parmanandpur O.P.) P.S. Case No.544 of 2017 registered under Sections 302, 201 and 120(B)/34 of the Indian Penal Code.
The accusation is that the marriage of the deceased, the daughter of the informant, was performed with Rajesh Swarnkar alias Chicho Swarnkar, son of Ramcharitra Swarnkar (petitioner no.2) before six years but after one year of her marriage, the
Patna High Court Cr.Misc. No.51823 of 2017 (2) dt.07-11-2017 2/3 deceased, the daughter of the informant, was being tortured for demand of motorcycle and cash Rs.1,00,000/- in dowry. Later on, Rajesh Swarnkar alias Chicho Swarnkar, son-in-law of the informant, informed him that his daughter has consumed poison and is admitted in the hospital. When the informant reached at the matrimonial house of his daughter, he found the door of the house locked and two children of his daughter not present there. On query, the informant came to know that his daughter has been killed and her dead body has been disposed of. Learned counsel appearing on behalf of the petitioners submits that the petitioners are brother-in-law, father-in-law, mother-in-law and two Nanads of the deceased, the daughter of the informant, respectively.
In fact, due to quarrel with her husband, the deceased, the daughter of the informant, consumed poison and died in course of treatment and her dead body was disposed of in presence of the informant but with an ulterior motive, the informant has lodged this false case. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.51823 of 2017 (2) dt.07-11-2017 3/3 satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Madhepura (Parmanandpur O.P.) P.S. Case No.544 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
