1. Heard learned counsel for the parties.
2. The petitioner has renewed his prayer for grant of regular bail in connection with Mashrakh P.S. Case no.578 of 2024, registered under sections 123, 105, 110, 61(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 and sections 30(a), 33, 34(a), 34(b), 37(A), 37(B), 47 and 34 of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, on having consumed spurious liquor, a number of persons fell ill and two of them died.
4. Learned counsel for the petitioner submits that the earlier prayer for bail of the petitioner was rejected vide order dated 9.6.2025 passed in Cr. Misc. no.3461 of 2025 giving liberty to the petitioner to renew her prayer for bail after framing
Patna High Court CR. MISC. No.58384 of 2025(2) dt.29-08-2025 2/2 of charge. Referring to the order brought on record as Annexure P/3 to the petition, it is submitted that charge has been framed against the petitioner in the learned trial Court on 24.7.2025. The petitioner has remained in custody since 6.12.2024 and undertakes to cooperate in the trial.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, the liberty granted in the earlier order of rejection dated 9.6.2025, charge having been framed against the petitioner in the learned trial Court on 24.7.2025 and the petitioner having remained in custody for more than 8 months since 6.12.2024, the Court directs the petitioner to be enlarged on bail in connection with Mashrakh P.S. Case no.578 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Exclusive Excise Judge-2, Saran at Chapra.
