JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-02-2017 The petitioner is in custody since 27.08.2016 in connection with Mufassil P.S. Case No. 9 of 2016, registered for offences punishable under Sections 498(A), 323, 341, 324, 307/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though this is a case under Section 498A, 307 and other Sections of Indian Penal Code but now the opposite party no. 2 is living in the house of the petitioner, in support of this contention opposite party no. 2 has herself sworn an affidavit.

Heard learned A.P.P. also.

Having heard both sides, in view of the submission of learned counsel for the petitioner, petitioner is directed to renew his prayer for bail before the Court concerned and on a day fixed

Patna High Court Cr.Misc. No.2885 of 2017 (2) dt.10-02-2017 2/2 by the Court below, the opposite party no. 2, shall also present herself in the court below, so that the court below will enquire about the aforesaid submission of learned counsel for the petitioner and only after satisfying himself, the court below shall release the petitioner on provisional bail for a period of six months and after verifying the conduct of the petitioner for next six months and satisfied with their happy married life, the provisional bail of the petitioner shall be confirmed, otherwise the learned Court below is free to pass any order as he deems fit. With the above observation, this application is disposed of.
